Terms and conditions of sale 

For the purpose of this contract the first party is Awak Travel Agency, and the second party is the client requesting services from Awak. 

For the purpose of this contract, the total amount in the quote (budget) is equivalent to the expected payment from the client to Awak Travel Agency. 

The total amount in the quote is for US dollars ($ USD.) Payment is to be completed in US dollars. 

The amount in the quote is for the services listed in the aforementioned quote. 

The total amount in the quote does not include: 

– International flights (round trip) 

– Cancellation / repatriation / all risk insurance 

– Meals and activities not mentioned in the quote or its attachments. – Beverages 

– Tips 

– Bank charges 

– Personal expense 

– Excess baggage 

– Local taxes (e.g. tourist tax, country entry and exit tax) 

 

Purchase order and payment method 

The contract between the client and Awak Travel Agency will be effective upon: (1) Written notification of the client related to accepting the quote , and (2) Confirmed deposit of 30% of the amount in the quote. 

Individuals and Groups up to 7 People: The remaining 70% of the total amount in the quote must be paid 45 calendar days prior to the first day of services. This clause is true for all quotes regardless of the number of travelers listed in the quote. 

Groups of 8 People and more:  The remaining 70% of the total amount in the quote must be paid 65 calendar days prior to the first day of services. This clause is true for all quotes regardless of the number of travelers listed in the quote. 

Payment of the full amount in the quote is required for all contracts confirmed as approved in writing by the client less than 45 days, for groups of 1 to 7 people, and 65 days, for groups of 8 people or more. Special conditions may apply in high tourist season or for services special or exceptional. 

Financial transaction charges to make payments to Awak, when applied, are paid by the client.

The protocol for payment, including information on how to make international money transfers, will be provided to the client. 

Once payment in full is confirmed, the client will receive a writing confirmation of services based on service availability at that time. 

 

Cancellations 

Cancelation of services are accepted only in writing, via email, to: ventas@awakcostarica.com 

Continue reading for the list of percentages from the total amount that will be retained as administrative expenses. 

Individuals and Groups up to 7 People: 

– 5% of the total amount will be retained if canceled more than 120 calendar days from the scheduled day of services. 

– 25% of the total amount will be retained if canceled between 61 and 119 calendar days from the scheduled day of services. 

– 50% of the total amount will be retained if canceled between 31 and 61 calendar days from the scheduled day of services. 

– 75% of the total amount will be retained if canceled between 16 and 30 calendar days from the scheduled day of services 

– 100% of the total amount will be retained if canceled 15 days or less from the scheduled day of services 

Groups of 8 People and more: 

– 5% of the total amount will be retained if canceled more than 240 calendar days from the scheduled day of services. 

– 25% of the total amount will be retained if canceled between 121 and 239 calendar days from the scheduled day of services. 

– 50% of the total amount will be retained if canceled between 61 and 120 calendar days from the scheduled day of services. 

– 75% of the total amount will be retained if canceled between 31 and 60 calendar days from the scheduled day of services 

– 100% of the total amount will be retained if canceled 30 days or less from the scheduled day of services 

Partial cancellation :

After a purchase order is created, price adjustments will not be made to a total amount billed if one or some members of a group cancel. Prices will not be adjusted as quotes are built and accepted for the number of members initially indicated and approved by the client. 

Cancellations during the stay:

Once a trip starts, any cancellation, trip interruption or service not engaged with by the customer will not be refunded. 

Any change or modification made by the customer that differ from the program defined in the purchase will be covered by the client and thus Awak Travel Agency will bear no financial responsibility 

Cancellation or modification at the initiative of the agency: 

If the deposit and payment of the balance are not received by the indicated date, the agency will have the right to withdraw from the contract and cancel the services reserved. This cancellation is the sole fault of the client for non-payment of the sums owed. See section titled Cancellations for penalties. . 

In the event that the agency is forced to cancel the client’s trip for any reason, (1) the client will be informed as soon as possible, (2) the client will be refunded the total amount received at that point for that purchase order. 

In case of cancellation or modification of one or more services related to the safety of the traveler, the client may not claim any compensation or reimbursement. For these safety related cases, Awak Travel Agency is not obligated to reimburse the amounts paid. 

 

 

Responsibility 

The agency shall not be liable in any way for the actions related to external events, such as: 

– Disturbances, cancellations or changes in transport to the destination (loss or train delays, international flights, cancellation of flights by the company) 

– Loss, theft or damage to luggage or other personal effects before or during the trip. – Failure to present identity and/or health documents or presentation of documents of insufficient validity or not in conformity with the required formalities (i.e. passports, visas, driving licenses, authorisations to leave the territory for minors, vaccination certificates.) 

– Unpredictable and insurmountable incidents or events such as: strikes, riots, wars, political unrest, bad weather, pandemics, terrorism, breakdowns, delays. 

In case of cancellation or modification of the trip as a result of one of these events, the additional costs incurred will be borne by the customer. 

The client is aware of his own personal responsibility for the decision to travel to a foreign country and the risks that this could generate. 

Awak Travel Agency and its employees will not be held responsible in the event of an accident due to the individual carelessness of one of the participants. 

The agency reserves the right to expel a participant who is considered to be rude, disrespectful, abusive, or who poses danger to the rest of the group or the safety of other participants. Expelled participants will not be refunded.

This contract serves as record that if a participant refuses to follow the guide’s instructions and by doing so causes him/herself harm or causes harm to others the agency and the guide hold no legal or financial responsibility and thus can not be prosecuted.

 

 

Insurance 

The agency has insurance that covers and guarantees civil and professional liability in accordance with applicable Costa Rican laws. 

The insurance held by Awak Travel Agency does not replace the customer’s underwriting of personal and individual insurance. Awak Travel Agency will provide clients with a list of specialized insurance organizations for the client to choose from. 

It is strongly recommended that the client take out additional insurance, which covers the specific travel risks (cancellation, illness, accidents, natural disasters, medical repatriations, etc.). 

The customer must have his own insurance contract for the duration of the trip. The customer’s decision to subscribe to an insurance contract or not is his/her own responsibility. 

Any activity outside the scope of the trip and the contract between Awak Travel Agency and the client will not be covered by Awak Travel Agency. 

In the case of high-risk activities, the client will be invited to take out specific additional insurance. 

The agency and its partners require the client to sign a liability waiver depending on the activity. If the liability waiver is not signed by the client, the service will not be provided and the client will not be reimbursed. 

Travel documents

 

Travel documents will be delivered electronically to the customer at least 10 days in advance of the beginning of the trip. 

The travel diary contains all the information necessary for the proper functioning of the Customer Journey: 

– Day-to-day summary with location, appointment time and contact of the suppliers services 

– Country information 

– Suggested additional activities 

– Directions (travel time) 

You will also receive the necessary contacts and the emergency number corresponding to the 24-hour assistance included in your stay. 

Applicable law 

The contractual relationship between the Client and the Agency is subject to Costa Rican law.
